1. ELIGIBILITY: Open only to legal residents of the United States or Canada (except Quebec) who are at least 13 years old as of the date of entry and have a valid email address. Employees of MovieSet Inc (“MovieSet”), Boll AG ("Sponsor"), and each of their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and/or those living in the same household of each, whether or not related, are not eligible. In the event that the winner of the Sweepstakes is younger than the age of majority in the state, province or territory where they reside, their parent or guardian must accept the Prize on their behalf. Void where prohibited by law. Sweepstakes is subject to all applicable laws, and is governed by the laws of the Province of British Columbia and the laws of Canada applicable therein.
2. HERE'S HOW TO ENTER: Beginning at 12:01 a.m. PacificTime ("PT") on April 14th, 2008 through 11:59 p.m. PT on May , 22nd (the "Sweepstakes Period"), visit www.movieset.com ("Site"), and click on the “Win What's In The Bag Contest” link to submit your entry. Registration is free. You will be asked to provide your name, street address, email address, phone number, and date of birth in order to register. To be eligible for drawing, entries must be received by 11:59 p.m. PT on May 22nd, 2008. Limit one (1) entry per person/email address/household per day. If more than one entry a day is received from any person/email address/household, all subsequent entries may be disqualified. Entries generated by script, macro or other automated or mechanical means are void. All entries become the property of Sponsor and will not be acknowledged or returned.
3. RANDOM DRAWING: The potential winner will be selected in a random drawing on or about May 23rd, 2008 from among all eligible entries received by MovieSet whose decisions are final and binding. Odds of winning will depend upon the number of eligible entries received.
4. WINNER NOTIFICATION: The potential winner will be notified on or about May 23rd, 2008 by email and may be required to execute and return a Declaration and Release Form, Release of Liability and, unless prohibited by law, a Publicity Release within seven (7) days of date of issuance of notification. In the event that any e-mail to a potential winner is returned as undeliverable or a response is not received to the e-mail within the specified time period, prize may be forfeited and, at Sponsor's discretion, an alternate winner may be selected for the drawing at issue. Noncompliance within this time period, the return of any prize or prize notification as undeliverable or noncompliance with these Official Rules will result in disqualification and, at Sponsor's discretion, an alternate winner will be selected for the drawing at issue. Prior to being declared a winner of a prize, the selected entrant may be required to correctly answer a time-limited mathematical skill-testing question without assistance of any kind, whether mechanical or otherwise, to be administered by phone or email.
5. PRIZE: One (1) Official “Mini Indy Hat” prize. The Prize is awarded "as is" with no warranty or guarantee, either express or implied by Sponsor. Prize is not transferable, redeemable for cash or substitutable except by Sponsor, who reserves the right to substitute a prize or portion of prize of comparable or greater value, at its sole discretion. Winner shall be solely responsible for all taxes and any other costs and expenses, including any costs of installation, associated with the acceptance and use of the prize not specified in these rules as being awarded. All prize details are at Sponsor's sole discretion.
6. GENERAL RULES: Acceptance of a prize constitutes permission for MovieSet, the Sponsor and its designees to use each winner's name, city and province/territory of residence and/or likeness for purposes of advertising and trade in any and all media now or hereafter known throughout the world in perpetuity, without further compensation, notification or permission, unless prohibited by law. By participating, entrants agree to (i) be bound by these Official Rules and the decisions of the Sponsor and judges, which are final and binding in all matters and (ii) release, discharge and hold harmless MovieSet, Sponsor, and each of their respective parents, subsidiaries, affiliates, retailers and advertising and promotion agencies, and their respective officers, directors, shareholders, employees, agents, attorneys and representatives (collectively, the "Released Parties") harmless from any and all claims and liability whatsoever for any injuries, losses or damages of any kind resulting from the acceptance, possession or use of a prize or participation in the Sweepstakes. In the event of a dispute as to identity of an entrant, entries will be deemed made by the authorized account holder of the e-mail address from which the entry was submitted and such person will be responsible for complying with all requirements set forth herein. "Authorized account holder" is defined as the natural person who is assigned to an email address by Internet access provider. Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, illegible or postage-due mail, entries or email; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or malfunctions of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or malfunctions which may occur in connection with the administration of the Sweepstakes, the processing of entries, the announcement of the prizes or in any Sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Sweepstakes or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and their entries void. If, in the judges' opinion, there is any suspected or actual evidence of tampering with any portion of the Sweepstakes, or if technical difficulties, virus, bugs or other causes beyond judges' control compromise the integrity of the Sweepstakes, Sponsor reserves the right in its sole discretion, to modify, suspend or terminate the Sweepstakes or any portion thereof without notice and/or terminate the participation of any entrant (and void his/her entry) whose conduct potentially compromises the Sweepstakes and, if terminated, at their sole discretion, conduct a random drawing to award the prize for the applicable drawing using all eligible, non-suspect entries received for such drawing as of the date of termination.
7. CONDITIONS OF PARTICIPATION: As a condition of participating, entrant agrees that a) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out of pocket expenses, if any, and b) all causes of action arising out of or connected with this Sweepstakes, or any compensation or credit to be provided, shall be resolved individually, without resort to any form of class action; and c) any and all claims, judgments, and award shall be limited to actual out of pocket costs incurred, if any, and in no event shall entrant be entitled to receive attorneys' fees or other legal costs.
8. DATA COLLECTION: Information submitted in connection with the Sweepstakes will be treated in accordance with these Official Rules and the MovieSet Privacy Policy (as may be amended from time to time), currently located at ww.movieset.com/privacy; provided, that in the event of any conflict between these Official Rules and such Privacy Policy, the terms and conditions of these Official Rules shall prevail.
